Sale Conditions

General and specific sale conditions :
The general sale conditions between a tour provider and customer are described in the article n°94 490 dated the 15th of June 94, as a result of law n°92-645 dated the 13th of July 92, fixing conditions to organise and sell tours. The details of these conditions will be printed on the back of your booking form.

Subscription :
The subscription to any trip on this web site imply the acceptance of the sale conditions existing between the tour provider and customer. It also implies the acceptance of the specific conditions below. The subscription sheet must be filled and signed before being sent to us. All subscriptions must be accompanied by a deposit of 30% of the total cost of the trip. The receipt of this deposit doesn't confirm a booking; booking is subject to room availability. For accepted bookings, we will send to you a booking contract detailing the services provided, costs, amount paid and balance due. The balance must be paid 30 days before the beginning of your trip. If the balance is not paid 30 days before the beginning of your trip, ESCAPADE GOURMANDE reserve the right to cancel the booking without refunding the deposit. In case of late booking, ie. less than 30 days before the starting date of your trip, the total cost of your trip must be paid; late subscription will incur an addition fee of 30 euros. Nevertheless, your booking will be effective only if there is availability when we receive your booking form.

Obligation and requirements :
Each person booking one of our trips declares themselves to be in a good health, and does not have any contra-indications to practise outdoor sports, and assumes the fact that there may be associated risks to cycling or walking (eg. falls, twists, etc) or bad weather conditions, or may find themselves remote from main medical centres. Knowing that, each one takes on himself not to transfer the responsibility of these risks to ESCAPADE GOURMANDE, or its subcontractors.

Insurance:
ESCAPADE GOURMANDE, tour organizer, is covered by a civil liability insurance Groupama which covers body and material damages that could occur to customers because of its failure. ESCAPADE GOURMANDE subscribes for all its customers a liability insurance, an individual accident insurance and a juridical protection. However, the cost of the trip does not include a cancellation insurance, or any insurance for your luggage in case of theft, destruction or loss.

Aid and assistance :
ESCAPADE GOURMANDE subscribes for its customers (living in France only) an assistance and repatriation insurance (beyond 50 km from their home). This insurance is automatically included in credit card contracts such as Visa, American Express, Diner's and in many personal insurance contracts. If a customer does not have any repatriation insurance, it is compulsory to purchase one, from an insurance company of his choice.

Cancellation costs: (or date alteration) :
30 euros per person more than 30 days before the departure. 30% of the total cost of the trip between 30 and 21 days before the departure. 50% of the total cost of the trip between 20 and 8 days before the departure. 75% of the total cost of the trip between 7 and 2 days before the departure. 90% of the total cost of the trip 1 day before the departure. 100% of the total cost of the trip beyond and in case of termination by the customer. If the organizer has to cancel, for any reason, customers will be refunded completely, but without any compensation. All interrupted, or delayed trips caused by the customer, for any reason, will not be refunded.

Formalities :
In any case, the organizer cannot endorse the individual responsibility of the customer. Any non respect of the local law, failure to give valid identity papers, personal delay, is the responsibility of the customer only, who will exclusively incur the additional costs .

Modification of provided service :
ESCAPADE GOURMANDE, acting for the customer through catering suppliers (hotels, restaurant, carriers, .) cannot endorse their liability; they assume it themselves. In case of extreme phenomena, unpredictable or particular circumstances, which involve customer security, the organizer reserves the right to modify dates, time schedules and itineraries, without the obligation to compensate the customer.

Tailor made tours (programme modification or development) :
From 8 persons : free quotation.
Less than 8 persons : development cost = 30 euros.

Costs :
All modifications of exchange rate, from carriers or others service suppliers could result in an adjustment of the published costs. Costs made on the 01/11/03 on the current exchange rates and on the current price of service providers at this date, are susceptible to adjustment before the departure date.

Contract cession :
According to the article n°18 dated on the 13th of July 1992, the contract cession is allowed. Please note that the cession operation can cost from 60 euros to 1000 euros, depending on the number of persons involved and on the proximity to the departure date.

Cancellation from the organizer :
The customer cannot be compensated or refunded, if the tour cancellation is due to major particular circumstances, which involve customer security. In addition, the customer cannot be compensated, if the cancellation is due to a lack of subscriptions, and occurs 21 days, or more, before the departure date.
